The United Kingdom’s first transgender Judge has launched a case against the United Kingdom in European court of human rights, challenging the process that led to the Supreme Court’s ruling on biological sex.
The retire Judge Victoria McCloud, now a litigation strategist at the W-Legal, is seeking a rehearing of the case, arguing that the Supreme Court undermined her article 6 rights to a fair trial when it refused to hear representation from her and did not hear evidence from any other trans individual or groups.
The judgment from the Supreme Court, which ruled that transgender women are not legally women under Equalities Act, has led to warnings it would “exclude trans people wholesale from participating in UK’s society. But gender critical campaigners have hailed the ruling as a victory for women.

Lawyers acting on behalf of Dr. Victoria McCloud, 55, who stood down last year, filed an appeal, arguing a breach of rights under the article six of the European Convention on Human Rights -the right of fair hearing and impartial hearing by an independent tribunal.
The move comes as For Women Scotland, the gender-critical campaign group that brought the Supreme Court case, announced it was suing the Scottish government, accusing it of refusing to abide by April’s judgement, in particular around schools and prison policy.
