Electoral Act: Deletion Of Section 84 (12): Court Receives Appeal Motion Against Judgement

Nigeria’s Attorney General and Minister of Justice, Abubakar Malami

A Federal High Court (FHC), Umuahia, will hear a motion seeking an order to grant leave to appeal against the ruling of a Federal High Court sitting in Umuahia , which earlier ordered the deletion of Section 84 (12) of the amended Electoral Act.

The section bars political appointees at any level to vote or be voted for “at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election”.

According to Justice Evelyn Anyadike, such a clause was unconstitutional.

Civil rights advocacy group, Human Rights Writers Association of Nigeria, on Monday through their counsel, Perfect Okorie informed the court of the motion on notice filed to the effect.

Others listed in the motion include the Attorney General of the Federation as defendant/respondent; Nduka Edede as Plantiff/Respondent.
