The appeal court sitting in Abuja Nigeria has today Tuesday affirmed the victory of Emeka Ihedioha of the PDP as duly elected governor of Imo state.
The court delivered the jugdement following an appeal filled by Governorship candidates of AA Uche Nwosu, candidate of APGA Ifeanyi Araraume andand candidate of APC Hope Uzodinma challenging the election victory of the governor.
Meanwhile,all appellants argued in their appeal that the governor did not meet the constitutional required one- quarter of the two- third of the 27 LGAs of the state,as provided under section 197 of the constitution.
The appellants therefore prayed the courtvto set aside the decision of thevtribunal and declarecthen winner of the election or oder a rerun alternatively in the state.
The court conmmenced the hearing with the appeal of Mr Uche Nwosu of the AA but they later upheld the preliminary objection by the PDP and Governor Ihedioha that the appeal was faulty.
According to the court,it ought to be ordinarilly dismiss the appeal but inlineinline with the supreme court’s guidelines it decided to go ahead and determine the appeal.
Though it took alot of time to get to this stage,after listening to the appeal and resolving all the issues raised by Uche and the AA against the PDP, the lead Judge,Justice Oyebisi Omoleye, ordered Mr Nwosu to pay a sum of 500,000 Naira.
On that of senator Ifeanyi Araraume and APGA, the court dismissed the appeal and equally awarded a cost of 500,00Naira against the appellants.
On that of aSenator Hope and the APC,the court held that the tribunal had looked at the evidence loophole placed before it and that it is settled law that “here say evidence is not admissible in court,awaded the cost of 500,000Naira against the appellants.
