Nigeria-US health agreement: Test of sovereignty and accountability

International assistance should strengthen national capacity, not compromise national sovereignty. Nigeria’s health cooperation agreement with the United States therefore demands rigorous scrutiny—not because American assistance is inherently suspect, but because agreements involving public health, substantial financial commitments and citizens’ biological information must satisfy the highest standards of transparency, accountability and national interest.

The fundamental question is not whether Nigeria needs assistance, but whether the terms under which that assistance is obtained adequately protect Nigerians.

The Financial Facts and the Question of Value

The financial figures require clarification. According to the Federal Ministry of Health and Social Welfare, the United States announced approximately $2.1 billion in grant funding, while Nigeria committed to mobilising approximately $3 billion in domestic health financing over five years. These figures contradict claims that America is providing $3 billion while Nigeria contributes $2.1 billion. The American commitment is also subject to applicable US approval processes.

Consequently, Nigerians deserve a comprehensive explanation of the funding arrangements, disbursement conditions, counterpart obligations and anticipated health outcomes. What proportion will support medicines, vaccines, laboratories, disease surveillance and healthcare personnel? What safeguards will prevent waste, duplication and diversion? How will performance be measured?

These are fundamental questions of public financial management, not expressions of hostility towards international cooperation.

Regulatory Sovereignty Must Remain Non-Negotiable

The most contentious allegation concerns whether the agreement restricts the National Agency for Food and Drug Administration and Control (NAFDAC) from independently testing American-supplied medicines and vaccines.

This allegation must be verified against the signed agreement. Nevertheless, the governing principle is unequivocal: Nigeria must not surrender its capacity to protect citizens from unsafe, substandard or ineffective medical products.

NAFDAC’s regulatory independence is not an obstacle to international partnership; it is an essential safeguard of public health. Any provision that unduly restricts its statutory authority warrants immediate clarification, legislative scrutiny and, where necessary, renegotiation.

Scientific cooperation cannot justify regulatory capitulation. No diplomatic relationship should place Nigerian patients in a position where the safety of medicines depends exclusively on assurances from a foreign government or supplier.

Health Data, Biological Specimens and National Interest

Another critical consideration is the governance of sensitive health information and biological specimens. Nigerians are entitled to know what information may be shared, who controls it, how long it may be retained, and whether it can be transferred to third parties.

If Nigerian health data and biological resources contribute to scientific discoveries or commercial pharmaceutical developments, what protections ensure that Nigeria benefits? Will resulting treatments remain affordable and accessible to Nigerian patients? These questions deserve contractual answers, not diplomatic platitudes.

Ghana’s reported rejection of its proposed American health compact over concerns including health-data protection demonstrates that governments can question proposed arrangements. However, Ghana’s decision does not establish that Nigeria’s agreement contains identical provisions.

Transparency Before Political Celebration

The Federal Government should publish the complete agreement, including its financing conditions, regulatory provisions, data-sharing obligations, implementation framework and termination clauses. The National Assembly, professional medical associations, public-health experts and civil society should examine its implications.

Equally, allegations that the programme will cause mass mortality or that particular regions will receive preferential allocations must not be presented as established facts without credible evidence. Responsible criticism must distinguish demonstrable risks from speculation.

Conclusion: Partnership Without Subordination

President Tinubu’s administration must understand that securing foreign assistance is not, in itself, proof of sound governance. The true measure is whether the agreement delivers measurable public-health benefits while preserving Nigeria’s regulatory independence, fiscal accountability and citizens’ rights.

Nigeria needs assistance without exploitation, cooperation without coercion, and investment without the surrender of sovereign responsibility.

The Nigerian people must never be expected to accept uncertainty in exchange for promises of free medicines. Every vaccine and medicine must meet applicable safety and quality requirements, irrespective of its country of origin or funding arrangement.

Ultimately, the question is not whether Nigeria should cooperate with America. It is whether Nigeria has negotiated wisely, protected its citizens adequately and retained the authority to act decisively in their best interests.

A government that negotiates in the people’s name owes them transparency. A government that commits public resources owes them accountability. And a government entrusted with public health must never place diplomatic convenience above human life.
