A member of the governing All Progressives Congress (APC), who asked a court to allow President
Muhammadu Buhari and the governors to contest for third term, has withdrawn his suit.
Charles Enya, the APC member, had in suit no.
FHC/AI/CS/90/19 filed on November 20, prayed the Federal High Court in Abakiliki, the Ebonyi State capital, to amend section 137(1) (b) and 182 (1) (b) of the Nigerian constitution to allow for a third term for the president and the governors.
He had told the court that the section of the constitution restricting the president and the governors to only run for two terms, infringed on the fundamental human rights of President Buhari and the governors ”who might wish to seek for a third term in office”.
However, when the matter came up for hearing on Wednesday, counsel to the applicant, Iheanachor Agboti, applied for withdrawal.
In withdrawing the suit Agboola said, “I have the instruction of my client to withdraw the suit so as to allow further consultation.”
The application was granted by the presiding judge, Akintayo Aluko.
Justice Aluko said, “Upon the application of the learned counsel for the applicant for the withdrawal of this suit, I say may the case be struck out.”
The APC chieftain from Ebonyi State had filed the suit after President Muhammadu declared during the party’s recent National Executive Council meeting in Abuja, that he had no intention to seek another term at the expiration of his second term.
Many Nigerians, including the APC, had condemned the suit.
