U.S. Representative John James (Republican–Michigan) has renewed calls on the Nigerian government to either release the leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, or grant him a fresh trial that complies with constitutional and internationally recognized human rights standards.

Speaking during proceedings in the U.S. House of Representatives while canvassing support for his proposed resolution, H.Res. 1321, James said Nigeria should ensure that all legal proceedings involving Kanu are conducted in line with the country’s constitutional obligations and internationally accepted human rights standards.

The resolution, introduced on May 22, 2026, has since been referred to the House Committee on Foreign Affairs. H.Res. 1321 is a non-binding House resolution urging the Nigerian government to uphold constitutional guarantees and international human rights commitments in Kanu’s case. It also encourages greater U.S. diplomatic engagement with Nigeria on issues relating to judicial fairness and the rule of law.

In supporting the resolution, James argued that Kanu’s continued detention raises concerns over due process, fair trial guarantees and adherence to internationally recognized human rights standards. He also suggested that future U.S. assistance to Nigeria should remain subject to continued congressional oversight where concerns relating to human rights and the rule of law persist.

James further called on Nigerian authorities to ensure Kanu has unhindered access to legal representation, adequate medical care and humane conditions of detention while encouraging stronger diplomatic engagement between the United States and Nigeria on issues relating to the rule of law.

James’ intervention has again placed Kanu’s long-running legal battle under international scrutiny, reinforcing global interest in one of Nigeria’s most closely watched court cases. The matter has continued to generate debate within Nigeria as well as among international human rights advocates, legal experts and members of the Nigerian diaspora.

The Nigerian government has consistently maintained that Kanu’s prosecution is being conducted in accordance with Nigerian law and established judicial procedures.

Authorities also insist that IPOB remains a proscribed organization in Nigeria and that the courts will determine the outcome of the case.

Kanu has pleaded not guilty to the charges against him, and his case remains pending before the Federal High Court, where no final judgment has been delivered.

The development is likely to generate renewed public debate over the case, with supporters and critics closely monitoring further legal proceedings and international reactions.

Speaking with 9News Nigeria, a notable Senior Advocate of Nigeria SAN reiterated the fact that the matter remains before Nigeria’s judicial system, where any future decisions regarding Kanu’s status will be determined in accordance with the Constitution and applicable laws.

As public interest continues to grow, stakeholders have urged Nigerians to remain calm, peaceful and law-abiding while allowing the legal process to run its full course.

Experts have also cautioned against actions or statements capable of undermining public order, emphasizing that the rule of law remains the appropriate avenue for resolving the matter.

Although the intervention by the U.S. lawmaker adds fresh international attention to the high-profile case, the final determination of Kanu’s detention or possible release remains a matter for Nigeria’s competent courts, in accordance with the Constitution and applicable laws.
