Chief Judge of the Federal High Court has assigned the lawsuit filed by former National Deputy Chairman of the African Democratic Congress, ADC, Nafiu Bala, challenging the party’s current leadership under former Senate President David Mark.
The case has now been transferred to Justice Peter Lifu for continued hearing and determination.
In the suit, Bala is seeking a court order restraining David Mark, former Osun State Governor Rauf Aregbesola, and other members of the ADC’s caretaker committee from carrying out responsibilities.
He contends that their appointments violate both the party’s constitution and the provisions of the Electoral Act.
Also joined in the lawsuit are the African Democratic Congress (ADC), the Independent National Electoral Commission (INEC), and the party’s former National Chairman, Ralph Nwosu.
The reassignment follows a directive for the matter to be heard without delay at the Federal High Court, under scoring the significance of the leadership dispute within the opposition party.
Meanwhile, lawyers representing the defendants had earlier opposed efforts to reassign the case, accusing the plaintiff of attempting to secure a court perceived to be more favorable to his position.
The development marks a fresh twist in the legal battle over the leadership and future direction of the ADC as the case proceeds before its new judge.
