The convener of one love family and caring ,Chief Patrick Eholor alongside a cso has filed a phantom Case on the 10th June 2024 over the unconstitutional removal of retired igp of Nigeria police and ex chair of police service commission in Dr Solomon Arase.
The suit was filed vide originating summons on the 28th June 2024 before the registry of federal high court, Abuja with suit no fhc/Abj/cs/880/2024 , the suit has the president of Nigeria and attorney general of federation as first and second defendants respectively.
The spokesman for the cso and plaintiffs who filed this case , in the person of Chief Patrick Eholor actually in his speech to the Nigeria press attributed the motivation to file this case is brewing from the decision of Nigeria President Bola Ahmed Tinubu action to remove the Chairman of the Police Service Commission (PSC), Dr. Solomon Arase on June 10, 2024 through a bery unlawful and strange unconstitutional manner. He said the process on the removal of ex psc chair is unconstitutional and serious aberration with no verifiable legal reasons advanced for the removal of Solomon arase.Chief Eholor said that the said Dr Solomon arase removal appears to have violated the established legal procedure for the removal of the PSC Chairman,which is in variance with Section 5, subsection 1 of the PSC Act which actually provides that:
“Notwithstanding the provisions of Section 4 of this Act, the Chairman and any other member, may at any time be removed from office by the President acting on an address supported by a two-thirds majority of the Senate praying that he be removed for inability to discharge the functions of the Office (whether arising from infirmity of mind or body or any other cause of misconduct).”
Chief Eholor also referred to provision of Section 6 (2) of the PSC Act, which stipulates that
“The Commission shall not be subject to the direction, control or supervision of any other authority or person in the performance of its functions other than as is prescribed in this Act”.
Chief Eholor then concluded that the president was in serious error to have sacked and removed Dr Solomon Arase without following the laid procedures of the law.
As at press time, when this case was filed today, the case has yet be assigned to Judge for determination in this regard.
